1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the smart-meter utility billing platform operated by Powerlah PLT (“we”, “us”, “our”) at https://app.powerlah.my (the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.
3. Description of the Service
The Service is a technology platform that provides smart-meter monitoring and billing management tools on behalf of property owners and administrators. The Service enables:
- Property owners and managers to register properties, assign smart meters, and manage tenancy billing
- Tenants to monitor their electricity consumption and prepaid credit balance
- Automated energy usage tracking and credit deduction based on smart meter readings
- Notifications and alerts related to credit balances and smart meter switch status
3.1 Nature of the Service — Important Disclaimer
Powerlah PLT is not an electricity retailer, distributor, supplier, or licensee under the Electricity Supply Act 1990 or any related legislation. We do not generate, transmit, distribute, sell, or supply electricity to any person.
The Service is provided solely as a technology and billing management tool acting on behalf of and under the instruction of property owners and administrators. All billing arrangements, tariff rates, credit policies, and smart meter switch configurations are determined exclusively by the property owner or administrator — not by Powerlah PLT.
The contractual relationship for electricity supply and billing exists between the property owner/administrator and their tenants. Powerlah PLT acts only as a service provider facilitating the metering, calculation, and communication of usage data as instructed by the property owner/administrator. Any payments or credit top-ups processed through the Service are transactions between the tenant and the property owner/administrator; Powerlah PLT merely provides the platform infrastructure.
Property owners and administrators are solely responsible for ensuring that their use of the Service and their billing arrangements with tenants comply with all applicable Malaysian laws, including but not limited to the Electricity Supply Act 1990, the Energy Commission Act 2001, and any regulations, guidelines, or directives issued by the Energy Commission (Suruhanjaya Tenaga).
4. User Accounts
4.1 Account Creation
Accounts are created by invitation from a property owner, manager, or system administrator. You may be required to complete your profile and set a password upon first login.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
We strongly recommend enabling two-factor authentication where available.
4.3 Accuracy of Information
You agree to provide accurate, current, and complete information when setting up or updating your profile, and to keep such information up to date.
5. User Roles and Responsibilities
5.1 Property Owners and Managers
If you are a property owner or manager, you are responsible for:
- Ensuring that property and room information is accurate
- Setting billing rates that comply with all applicable laws, regulations, and guidelines issued by the Energy Commission (Suruhanjaya Tenaga) or any other relevant authority
- Obtaining any licence, approval, or exemption required under the Electricity Supply Act 1990 or related legislation for your billing arrangement with tenants
- Managing tenant invitations and assignments appropriately
- Ensuring tenants are informed of the billing arrangement and these Terms
- Bearing full legal responsibility for the billing relationship with tenants — Powerlah PLT has no liability for disputes arising from rates, policies, or arrangements you configure
5.2 Tenants
If you are a tenant, you acknowledge that:
- Your electricity usage is monitored by smart meters and billed according to the policy set by your property owner or administrator
- The billing arrangement is between you and your property owner/administrator — Powerlah PLT is not a party to that arrangement and does not sell electricity to you
- Prepaid credit balances may be exhausted, which may result in the smart meter switch being turned off automatically based on the settings configured by the property owner/administrator in the Service (which constitute their express instructions to us). Reasonable effort is made to notify you via email prior to any smart meter switch turn-off, however we do not guarantee that such notifications will be received in time.
- You are responsible for maintaining adequate credit balance where a prepaid policy applies
- Any disputes regarding billing rates or policies should be directed to your property owner/administrator
6. Fees and Payments
Access to the Service is provided at no subscription fee to all users. However, transactions processed through the Service (such as electricity credit top-ups) may include a platform fee for the use of our technology infrastructure.
Platform fees are incorporated into the transaction amount and are not separately itemised. By using the Service, you acknowledge and agree that platform fees may apply and that the specific quantum of such fees may not be disclosed. Platform fees are charges for the use of our technology service only and do not constitute payment for the sale or supply of electricity. We reserve the right to modify fee structures at any time without prior notice.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorised access to any part of the Service, other accounts, or connected systems
- Interfere with or disrupt the integrity or performance of the Service or smart meter devices
- Tamper with, bypass, or manipulate smart meters or energy readings
- Upload malicious code, viruses, or harmful content
- Use the Service to harass, abuse, or harm other users
- Reverse engineer, decompile, or disassemble any part of the Service
8. Intellectual Property
All content, software, designs, trademarks, and other intellectual property associated with the Service are owned by or licensed to Powerlah PLT. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose only.
You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.
9. Energy Data and Smart Meters
The Service relies on data transmitted by smart meters installed at the property. You acknowledge that:
- Energy readings are provided on an automated basis and may occasionally be delayed or interrupted due to connectivity or hardware issues
- We are not responsible for the accuracy of meter hardware or sensor readings beyond the software calculations performed by the Service
- Billing calculations are based on the data received from smart meters and the tariff rates configured by the property administrator
10. Service Availability
The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation. We may suspend or restrict access to the Service at any time for maintenance, upgrades, or other operational reasons, with reasonable notice where practicable.
11. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunity, or goodwill.
- Our total aggregate liability for any claim arising from or related to the Service shall not exceed the total fees paid by you to us in the 12 months preceding the event giving rise to the claim.
- We shall not be liable for any loss or damage arising from:
- Smart meter switches being turned off as a result of exhausted prepaid credit or property administrator configurations — such actions are carried out solely based on the settings configured by the property owner/administrator in the Service (which constitute their express instructions to us)
- Inaccurate smart meter readings caused by hardware malfunction
- Unauthorised access to your account due to your failure to maintain credential security
- Actions or omissions of property administrators in setting billing rates, policies, or smart meter switch configurations
- Any claim that the billing arrangement between a property administrator and tenant constitutes an unlicensed sale or supply of electricity
12. Indemnification
You agree to indemnify and hold harmless Powerlah PLT, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service in violation of these Terms
- Your breach of any applicable law or regulation, including without limitation the Electricity Supply Act 1990 and any related energy regulations
- Any dispute between property administrators and tenants regarding billing arrangements facilitated through the Service
- Any claim by a third party (including any regulatory authority) that your use of the Service constitutes an unlicensed sale, distribution, or supply of electricity
13. Termination
13.1 By Us
We or the relevant property administrator may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. In cases of material breach of these Terms, termination may be immediate without prior notice.
13.2 By You
You may request account deletion at any time by contacting us at [email protected].
13.3 Effect of Termination
Upon termination:
- Your right to access the Service ceases immediately
- Any outstanding credit balances are subject to the arrangements between you and the property administrator
- Provisions that by their nature should survive termination (including limitations of liability, indemnification, and governing law) shall continue in effect
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.
15. Dispute Resolution
In the event of any dispute arising from or in connection with these Terms or the Service:
- Mediation: The parties shall first attempt to resolve the dispute amicably through mediation. Either party may initiate mediation by written notice to the other. The parties shall agree on a mediator within 14 days of such notice, or failing agreement, either party may apply to the Asian International Arbitration Centre (AIAC) for appointment of a mediator.
- Court proceedings: If the dispute is not resolved within 30 days of the commencement of mediation (or if either party refuses to participate), either party may commence proceedings in the courts of Malaysia, which shall have exclusive jurisdiction.
16. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated by posting the revised Terms on the Service with an updated “Last Updated” date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
If you do not agree with the revised Terms, you must discontinue use of the Service.
17. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Powerlah PLT regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, or government actions.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Subject to the dispute resolution process in Section 15, the courts of Malaysia shall have exclusive jurisdiction over any proceedings arising from these Terms.
